Agreement between the User and MAGNIFICENT HOSPITALITY AND TOURS

APPLICABILITY OF THE AGREEMENT

This agreement (“User Agreement”) establishes the Terms of Service under which MAGNIFICENT HOSPITALITY AND TOURS provides travel and hospitality solutions to the person(s) (“the User”) utilizing our website or any of our bespoke services.

Both the User and MAGNIFICENT HOSPITALITY AND TOURS are individually referred to as a ‘Party’ and collectively as the ‘Parties.’

The Terms of Service herein apply equally to both singular and plural forms of the terms defined. As the context requires, any pronoun shall include the corresponding masculine, feminine, and neuter forms. The terms “include,” “includes,” and “including” are deemed to be followed by the phrase “without limitation.” Unless otherwise specified, terms such as “herein,” “hereof,” and “hereunder” refer to this agreement in its entirety.

Users engaging the services of MAGNIFICENT HOSPITALITY AND TOURS are deemed to have read, understood, and expressly accepted these Terms of Service. This agreement governs the transaction and provision of services by MAGNIFICENT HOSPITALITY AND TOURS for all purposes and is binding upon the User. All rights and liabilities of the User and/or MAGNIFICENT HOSPITALITY AND TOURS regarding any provided services are strictly limited to the scope defined within this agreement.

MAGNIFICENT HOSPITALITY AND TOURS reserves the right, at its sole discretion, to terminate access to any of its websites or sales channels and related services at any time, without prior notice, for maintenance or any other reason deemed necessary.

In addition to this Agreement, specific Terms of Service (TOS) apply to individual products offered by MAGNIFICENT HOSPITALITY AND TOURS, such as holiday packages, activities, and various modes of transportation. These specific terms are integrated into this Agreement by reference; however, should a conflict arise between a specific TOS and this Agreement, the terms of this Agreement shall prevail.

Furthermore, we may provide guidelines governing particular features or offers. It is the User’s responsibility to ensure compliance with the rules and policies of the specific Service Provider (e.g., airlines, hotels) with whom they choose to deal, including fare rules and contracts of carriage.

For the avoidance of doubt, the use of services constitutes an explicit acknowledgement and acceptance of this Agreement. If the User does not agree with any part of these terms, they must refrain from utilizing the services of MAGNIFICENT HOSPITALITY AND TOURS.

MAGNIFICENT HOSPITALITY AND TOURS implements rigorous safety measures to ensure a secure environment during travel and stay. However, we believe it is the User's fundamental responsibility to exercise personal caution. Users must acknowledge the inherent risks associated with outdoor excursions and various transport modes. In the event of an unforeseen incident, the User releases MAGNIFICENT HOSPITALITY AND TOURS and its employees from any liability or claims arising from participation in programs conducted by MAGNIFICENT HOSPITALITY AND TOURS.

Users remain responsible for their personal belongings throughout the journey. All fixed-departure tours are non-smoking and alcohol-free unless otherwise stated. Users are expected to arrive at designated pickup points via their own arrangements and must abide by all safety guidelines provided by MAGNIFICENT HOSPITALITY AND TOURS.

It is a mandatory requirement for any User on a MAGNIFICENT HOSPITALITY AND TOURS expedition to hold valid travel insurance, including comprehensive medical and emergency evacuation coverage. MAGNIFICENT HOSPITALITY AND TOURS strongly recommends coverage for cancellations and baggage. Documentation must be presented to our representative prior to the start of the trip.

Given the unique geographical locations in which MAGNIFICENT HOSPITALITY AND TOURS operates, the company and its staff do not accept responsibility for loss, injury, or delays arising during the tour. MAGNIFICENT HOSPITALITY AND TOURS reserves the right to alter or shorten itineraries for safety reasons, with any resulting external costs borne by the User.

Provision of "Next of Kin" contact information is mandatory for all participants on a MAGNIFICENT HOSPITALITY AND TOURS trip.

THIRD PARTY ACCOUNT INFORMATION

By utilizing Account Access services on MAGNIFICENT HOSPITALITY AND TOURS websites, the User authorizes MAGNIFICENT HOSPITALITY AND TOURS and its agents to access designated third-party sites, such as banks and payment gateways, to retrieve necessary transaction information.

Upon registration, the User will select a password and is solely responsible for maintaining its confidentiality. The User is fully accountable for all activities occurring under their account. MAGNIFICENT HOSPITALITY AND TOURS must be notified immediately in writing of any unauthorized account use. MAGNIFICENT HOSPITALITY AND TOURS shall not be held liable for losses incurred due to unauthorized account access.

PAYMENT AND CANCELLATIONS

Following a booking, MAGNIFICENT HOSPITALITY AND TOURS will issue a confirmation. A non-refundable token deposit of INR 2,000 per traveler must be paid to MAGNIFICENT HOSPITALITY AND TOURS within 07 days to secure the seat. Full payment is due 60 days prior to the tour start date. Failure to settle the balance by this deadline will result in the termination of the booking and forfeiture of the deposit.

During peak seasons such as Christmas, New Year, and Diwali, premium charges may apply. Full payment for these periods is required 90 days in advance, and cancellations within this window incur a 100% loss of payment.

Specific inclusions for each MAGNIFICENT HOSPITALITY AND TOURS trip are detailed in the TOS section of the respective event page. We encourage a thorough review of the itinerary prior to booking.

Cancellations must be submitted in writing or via email to MAGNIFICENT HOSPITALITY AND TOURS; verbal notifications are not valid. The following fees apply:

  • 60+ days prior to departure: Loss of deposit.
  • 60 to 31 days prior to departure: Loss of 50% of the tour cost.
  • Within 30 days of departure: No refund.

No refunds are granted for voluntary early departures or unutilized services.

All MAGNIFICENT HOSPITALITY AND TOURS group trips require a minimum of 4 passengers. If this requirement is not met, MAGNIFICENT HOSPITALITY AND TOURS may cancel the tour, providing at least 60 days' notice and a full refund of the trip cost. MAGNIFICENT HOSPITALITY AND TOURS is not liable for incidental costs like flight tickets or visas. For cancellations caused by Force Majeure (war, natural disasters, etc.), MAGNIFICENT HOSPITALITY AND TOURS will not issue refunds but will assist the User with insurance claims.

MAGNIFICENT HOSPITALITY AND TOURS reserves the right to adjust fees without notice. The User is responsible for all associated taxes and duties. In the event of a technical short-charge, MAGNIFICENT HOSPITALITY AND TOURS reserves the right to claim the balance post-transaction.

If a reservation cannot be confirmed, MAGNIFICENT HOSPITALITY AND TOURS will process a refund but is not obligated to provide a compensatory booking. Refund requests made more than 5 days after the departure date will not be entertained.

CONFIDENTIALITY

Information designated as confidential by MAGNIFICENT HOSPITALITY AND TOURS must be protected by the User and disclosed only as required by law. The privacy of User data is governed by our official Privacy Policy.

RIGHT TO USE MOVIE CLIPPINGS AND PICS

The User grants MAGNIFICENT HOSPITALITY AND TOURS the right to use images and video footage captured during the trip for promotional purposes.

RESPONSIBILITY OF THE USER

MAGNIFICENT HOSPITALITY AND TOURS is responsible only for transactions facilitated through its own platforms. We do not screen the legality of transactions relative to the User's local laws.

Users must complete all medical procedures, such as inoculations, before the journey. MAGNIFICENT HOSPITALITY AND TOURS is not liable for health issues encountered during the trip. The User warrants they are of legal age to enter a contract and will comply with all relevant laws and safety guidelines. Alcohol and cigarette consumption are prohibited during the trip unless expressly agreed upon with MAGNIFICENT HOSPITALITY AND TOURS.

ADVERTISERS AND LINKED WEBSITES

MAGNIFICENT HOSPITALITY AND TOURS is not responsible for errors or representations found on linked third-party websites. Inclusion of such links is for convenience and does not imply an endorsement by MAGNIFICENT HOSPITALITY AND TOURS.

FORCE MAJEURE CIRCUMSTANCES

The User acknowledges that exceptional circumstances (e.g., weather, strikes, government decisions) may prevent service providers from honoring bookings. While MAGNIFICENT HOSPITALITY AND TOURS will strive to offer alternatives or facilitate refunds where possible, the User agrees that MAGNIFICENT HOSPITALITY AND TOURS, acting as an agent, is not liable for such disruptions.

The maximum liability of MAGNIFICENT HOSPITALITY AND TOURS under any circumstances is limited to the refund of the amount received from the customer, minus applicable service and cancellation charges.

PROPRIETARY RIGHTS

Content provided by MAGNIFICENT HOSPITALITY AND TOURS, including graphics and media, is protected by intellectual property laws. Users may not copy or distribute this material without express written authorization from MAGNIFICENT HOSPITALITY AND TOURS.

VISA AND TRAVEL DOCUMENTS

Obtaining the necessary visas and travel documents is the sole responsibility of the User. MAGNIFICENT HOSPITALITY AND TOURS is not liable for travel issues arising from missing or invalid documentation and will not offer refunds in "no-show" scenarios.

PERSONAL AND NON-COMMERCIAL USE LIMITATION

Unless specified, services are for personal use only. Users may not modify, copy, or sell any information obtained from MAGNIFICENT HOSPITALITY AND TOURS for commercial purposes, nor may they use automated means to "scrape" or monitor our website content without permission.

INDEMNIFICATION

The User agrees to indemnify and hold harmless MAGNIFICENT HOSPITALITY AND TOURS and its affiliates against any losses or legal fees arising from the User's breach of this agreement or non-performance of obligations.

RIGHT TO REFUSE

MAGNIFICENT HOSPITALITY AND TOURS reserves the right to decline any order without providing a reason. We may also suspend or terminate User access if there is a breach of terms or if provided information cannot be verified.

RIGHT TO CANCELLATION DUE TO INVALID INFORMATION

The User must provide accurate information. Any misrepresentation entitles MAGNIFICENT HOSPITALITY AND TOURS to cancel bookings without notice. The User indemnifies MAGNIFICENT HOSPITALITY AND TOURS against claims arising from such protective measures.

UPDATION OF INFORMATION

While MAGNIFICENT HOSPITALITY AND TOURS acts with due diligence, technical inaccuracies may occur. Improvements and corrections are made periodically without notice. Users should rely only on advice from authorized representatives of MAGNIFICENT HOSPITALITY AND TOURS.

MODIFICATION OF TERMS

MAGNIFICENT HOSPITALITY AND TOURS reserves the right to modify these Terms of Service and associated charges at any time.

DISCLAIMER

MAGNIFICENT HOSPITALITY AND TOURS provides the Site in good faith. While we strive for accuracy, we cannot guarantee that third-party information or opening hours remain unchanged. MAGNIFICENT HOSPITALITY AND TOURS disclaims all liability for damages arising from the use of the Site or its content.

JURISDICTION

MAGNIFICENT HOSPITALITY AND TOURS expressly disclaims implied warranties from other jurisdictions. This agreement is governed solely by the laws and courts of Jaipur, Rajasthan.

RESPONSIBILITIES OF USER VIS-À-VIS THE AGREEMENT

The User expressly acknowledges that the use of services is undertaken at their own risk. To the extent that MAGNIFICENT HOSPITALITY AND TOURS acts solely as a booking agent for third-party service providers, it shall bear no liability regarding the quality or standards of the services rendered by such providers. Under no circumstances shall MAGNIFICENT HOSPITALITY AND TOURS be held accountable for the services delivered by these independent entities. All services are provided on an “as is” and “as available” basis. MAGNIFICENT HOSPITALITY AND TOURS reserves the right to modify the features or functionality of its services at any time, at its sole discretion and without prior notice. MAGNIFICENT HOSPITALITY AND TOURS expressly disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No advice or information, whether conveyed orally or in writing, obtained by the User from MAGNIFICENT HOSPITALITY AND TOURS or through its services, shall create any warranty not explicitly stated herein or within the specific Terms of Service. If the User does not agree with any of the aforementioned terms, they are advised to refrain from reviewing the material on any MAGNIFICENT HOSPITALITY AND TOURS platforms or utilizing any content, information, or materials provided by MAGNIFICENT HOSPITALITY AND TOURS. The sole and exclusive remedy for a User in the event of any disagreement, in whole or in part, with this agreement is to discontinue the use of services after providing written notice to MAGNIFICENT HOSPITALITY AND TOURS.

The User is required to adhere strictly to the safety guidelines issued by MAGNIFICENT HOSPITALITY AND TOURS through electronic correspondence, pamphlets, or other communication channels from time to time.

"I recognize that traveling with MAGNIFICENT HOSPITALITY AND TOURS offers an opportunity to broaden my horizons; however, I acknowledge that in doing so, I may encounter elevated risks beyond those typical of other global regions or standard package holidays. I understand that I am embarking on a journey with inherent dangers. I am aware that I may be traveling to regions where the standards of cleanliness, hygiene, accommodation, transport, safety, medical facilities, telecommunications, and infrastructure may differ from those I am accustomed to at home. I have thoroughly read and understood all the travel notes provided by MAGNIFICENT HOSPITALITY AND TOURS for this region. I have disclosed all relevant details of any pre-existing medical conditions to MAGNIFICENT HOSPITALITY AND TOURS. I accept these risks and obligations, fully assuming the responsibilities of travel. I hereby release MAGNIFICENT HOSPITALITY AND TOURS from any liabilities associated with these risks to the maximum extent permitted by law."

Acceptance of Conditions

By submitting the booking deposit, the User confirms their agreement to these terms and conditions and acknowledges that they have been read and accepted in full.
